THE DETAILS The case stems from a Customs seizure of imitation Huda Beauty products imported by Vision Enterprises. Upon verification, Huda Beauty confirmed the products were counterfeit and initiated legal proceedings. The Court ruled in favor of Huda Beauty, citing clear trademark infringement, and granted a permanent injunction prohibiting the import, sale, and advertisement of goods bearing marks identical or deceptively similar to Huda Beauty’s registered trademarks.
The Court also directed Indian Customs to destroy the seized counterfeit goods in accordance with the Intellectual Property Rights (Imported Goods) Enforcement Rules, 2007. Huda Beauty presented evidence of its brand’s trademark registrations, global reach, and retail partnerships in India, including with Nykaa and Sephora. The defendant did not contest the claims.
