ALDI Sued by Mondelez Over Alleged OREO, Chips Ahoy! Copycats

Fan-favorite grocery and home goods store ALDI is facing legal action, as The Takeout noted, for allegedly presenting some of its private label snacks in a manner that too closely resembles products offered by Mondelez International — a company most famous for treats such as OREOs, Chips Ahoy! cookies, Ritz crackers, and others.

The lawsuit, filed with the United States District Court for the Northern District of Illinois, alleges (in part) the following:

“Defendant [ALDI], by its marketing and sale of the Infringing Products, seeks to ride the coattails of the substantial reputation of the Mondelēz Trade Dresses in order to benefit from its power of attraction, fame and/or prestige, and to exploit the marketing effort expended by Mondelēz. Defendant’s clear intent is to take advantage of the reputation of the Mondelēz Trade Dresses to assist it to sell the Infringing Products.”

More specifically, as Food Dive reported, the Mondelez products being subject to copycat private label offerings include Chips Ahoy!, Nilla Wafers, Nutter Butter, OREO cookies, Premium saltine crackers, Ritz crackers, and Wheat Thins.

Throughout the filing, which numbers 36 pages, Mondelez made the case for copyright infringement on ALDI’s part, providing images of its products placed in proximity to ALDI’s private label equivalents to show presumed similarity.

In the case of the famous Chips Ahoy! cookie, ALDI’s Benton’s brand chocolate chip cookies are described as sharing a similar packaging color, a similar font complete with like colors and accent colors matching Mondelez’s product, and a somewhat matching logo location. In nearly all of the examples cited by the plaintiff, the focus of the argument centered on matching packaging colors, images, and font selection.

Mondelez concluded the May 27 filing by demanding a jury trial regarding all issues related to the case.
