Uncertainty persists over key mining Bill clauses as Mantashe publishes erratum

The latest version of the Mineral Resources Development Bill of 2025, released for public comment on May 20, is unlikely to meet its objectives and may instead prolong regulatory uncertainty, according to law firm Herbert Smith Freehills partner Peter Leon. Speaking during a webinar hosted by the law firm last month, Leon noted that the Bill appears to resurrect two of the most problematic themes from the withdrawn 2013 MPRDA Amendment Bill – the beneficiation and transformation mandates – along with other contentious issues.
